Bicyclists have just as many rights to use bike lanes as a motor vehicle using the road. However, they need to abide by all applicable laws, as well, just as cars do. If one or the other fails to adhere to the rules of the road, they can place themselves and others in danger of being in an accident. If a vehicle does negligently enter your bike lane, which causes you to have an accident, you may be entitled to just and fair compensation equal to the amount of your pain and suffering and other damages. Victims of bicycle accidents should listen to the expert Boston bicycle accident attorneys at the Law Offices of Gilbert R. Hoy, Jr. and Affiliates who have decades of experience to find out what legal remedies they have.
Railroad crossing gates were down when Jeffrey D. King rode his bicycle across the tracks and was fatally struck by a Brightline train January 17 in Boynton Beach, Florida according to video recorded from the train’s locomotive. The video backs up Brightline’s statements that all safety equipment was working correctly at the time of the incident, a claim the deceased’s family had initially questioned. The video, released by Boynton Beach police, shows Mr. King riding around the closed crossing arms in an apparent attempt to beat the train, which was traveling at 78 mph.
Mr. King is seen being clipped by the right side of the train. The impact threw him nearly 100 feet. The case has been classified as an accidental death but remains active pending further details from the medical examiner. Mr. King’s incident was not the only one of its kind. There have been three other incidents in which a bicyclist has been struck by Brightline trains, including two fatally, in this year alone.
